      This is the current action steps that Albion College will have in place to stay "Together Safely" in the summer:

      • Unvaccinated participants must wear a mask or face covering when indoors.*
      • Participants are encouraged to practice physical distancing.

                                    RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK
                                                            AND INDEMNITYAGREEMENT
         
      I hereby acknowledge, on behalf of my minor child "Participant," that Participant has voluntarily elected to enroll in the   Camp Program:  Women's Basketball Team Camp      ("Program”), to be held in and around   Albion College Campus, on:    June 10, 17, 25, 26, 27 of 2021   . I further understand that if Participant is a minor, then I, as his or her parent or legal guardian must agree to all of the conditions set forth below on behalf of the minor even where the language is specifically directed to Participant.  In consideration for being permitted by ALBION COLLEGE to participate in the Program, I hereby acknowledge and agree to the following:                                

      RULES AND REQUIREMENTS: I agree to conduct myself in accordance with Albion College’s policies and procedures, including the Minors on Campus, which appear in the Albion College Web Site.  I further agree to abide by all the rules and requirements of the Program and the rules listed in the signed contract.  I acknowledge that Albion College has the right to terminate my participation in the Program if it is determined that my conduct is detrimental to the best interests of the group, my conduct violates any rule of the Program, or at Albion College’s discretion. 


      INFORMED CONSENT:   I have been informed of and I understand the various aspects of the Program.  I understand and agree that I will engage in physical activities, [including water-sports activities,] which may pose a risk of harm.  I understand that these activities include but are not limited to: playing, observing or participating in Program activities, traveling to and from Program events.

      I further understand that the Program in which I am participating involves a swimming pool.  I am aware that any contact with a swimming pool involves certain risks, including but not limited to: death, drowning, or other personal injury as a result of the area’s conditions, the acts of third parties or other unknown safety hazards, diving injury, skin, eye, lung and ear irritation, injuries resulting from loss of balance and footing on aquatic surfaces, injuries resulting from lack of oxygen, injuries due to conditions of equipment, unpredictability of weather and the water conditions, wildlife, first aid operations or procedures of Releases (as defined herein) and/or others, and that there may be other risks not known to me or not reasonably foreseeable at this time.] 


      RELEASE AND WAIVER OF LIABILITY:  I, on behalf of myself, my personal representatives, heirs, executors, administrators, agents, and assigns,

      I hereby release, waive, and discharge Albion College and its Board of Trustees, its officers, agents, employees and representatives from all claims, demands, liabilities, rights and causes of action of whatever kind or nature, that may result from or occur during my participation in this ACTIVITY, whether caused by negligence of the College, its Board of Trustees, officers, agents, employees or representatives or otherwise. I also agree to indemnify and hold harmless the College for any loss, liability, damage or costs, including court costs and attorney’s fees that may occur as a result of my negligent or intentional act or omission while participating in this ACTIVITY.

      I further agree that the Releases are not in any way responsible for any injury or damage that I sustain as a result of my own negligent or grossly negligent acts or my own intentional misconduct and I hereby release Releases from any liability for the same.

      PHOTO RELEASE: I hereby grant ALBION COLLEGE the absolute and irrevocable right and permission, with respect to photographs and videos taken and/or comments made by the above named minor(s) or in which the minor(s) may be included with others, to copyright for same; to use, reuse, and publish the same in whole or in part in any and all media including use on the World Wide Web, now or hereafter, and for any purpose whatever for illustration, promotion, art, advertising, and trade, and if appropriate, to use the persons name and pertinent biographical facts as ALBION COLLEGE chooses. 

      I hereby release and discharge ALBION COLLEGE from any and all claims and demands arising out of or in connection with the use of photographs, videos, and/or comments, including without limitation any and all claims for libel or invasion of privacy. I have read the foregoing and fully understand its contents. 

      This release shall be binding on me and my heirs, legal representatives, and assigns.

      NON-EMPLOYEE STATUS:  I understand and acknowledge that in participating in the Program, I am doing so independently and that I am not an employee or agent of Albion College. I understand and agree that as a non-employee that I am not entitled to receive compensation or any other employee benefit from Albion College for my participation in the Program.

      CHANGE OF VENUE:  Albion College reserves the right to change the venue to a similar venue and/or to change the dates of the Program if the original venue is not available on the originally planned date.  Such change of venue or schedule shall not void this Agreement.

      CHOICE OF LAW: I hereby agree that this Agreement shall be construed in accordance with the laws of the State of Michigan 

      SEVERABILITY: If any term or provision of this Agreement shall be held illegal, unenforceable, or in conflict with any law governing this Agreement the validity of the remaining portions shall not be affected thereby.  


      I hereby acknowledge that I have read, understand and will abide by each of the terms and conditions of this Agreement. I understand that I may seek legal counsel of my own choosing to fully explain any terms of this Agreement to me before I sign it.

      ASSUMPTION OF THE RISK AND WAIVER
      OF LIABILITY RELATING TO CORONAVIRUS/COVID-19


      Albion College has put in place numerous preventative measures and enhanced cleaning protocols to reduce the likelihood of spreading COVID-19 at Albion College. However, Albion College cannot guarantee that you or your child will not become infected with COVID-19. Further, attending a Albion College summer camp session could increase your child’s risk of contracting COVID-19.

      I voluntarily accept, acknowledge and agree, and will follow, as parent or guardian on behalf of my child, the following conditions or requirements.

      1. Based on COVID-19, I verify that neither myself nor my child has any underlying health conditions making myself or my child particularly vulnerable to COVID-19, and that I have discussed my child’s participation in camp with his/her healthcare provider including considerations related to the risk of COVID-19. I verify that neither myself nor my child has shown any symptoms of COVID-19, in the past 10 days, including cough, shortness of breath or difficulty breathing, fever of 100.4◦F or higher , chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. 

      1. If my child develops these symptoms, tests positive at Albion College, or becomes a close contact during the Albion College camp, my child will not be able to participate in the camp.  I accept, agree and acknowledge if any of the previous conditions occur, I will pick up my child prior to the end of the day and no later than 8:00pm on the day of symptoms or of a positive test result.  Additionally, if I or my child or anyone in the child’s household tests positive for COVID-19, my child will not be able to participate in the camp, and I will pick up my child under the same conditions as stated.  

      1. I acknowledge the contagious nature of COVID-19 and voluntarily agree to the participation terms. I assume the risk that my child, myself, and other family members may be exposed to or infected by COVID-19 by attending any camps and activities at Albion College, and that such exposure or infection may result in personal injury, illness, permanent disability or death. 

      1. I agree and accept the risk that the camp could be closed at any time based on a person experiencing COVID-19 symptoms, including cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, new loss of taste or smell, or anyone testing positive for COVID-19

      1. Albion College will, to do the best of their ability, to require and enforce all applicable requirements which may assist in offering protection from the COVID-19 epidemic, as specified in the Center for Disease Control guidelines. These include, but are not limited to social distancing, guidelines related to sharing of supplies, crafts and equipment, and cleaning and hand washing. I understand the atmosphere of the camp may not allow perfect enforcement,  and I assume the risk of my child’s participation and waive and release Albion College from all claims and liabilities of any kind related to that participation or any requirement imposed on my Child as Albion College makes their best efforts to comply with the guidelines.

      1. I understand that the risk of becoming exposed to or infected by COVID-19 at Albion College may result from actions, omissions, or negligence of myself, my child and others, including, but not limited to, Albion College employees, volunteers, other campers and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injuries to my child, myself, and other family members (including, but not limited to, personal injury, disability or death), illnesses, damages, losses, claims, liability, costs or expenses, of any kind (collectively, “Claims”), that I, my child and our family may experience or incur in connection with my child’s attendance at Albion College summer camps and programs. 

      1. On my behalf, and on behalf of my child, I hereby release, covenant not to sue, discharge, and hold harmless Albion College, its employees, volunteers, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions or negligence of Albion College, its employees, volunteers, agents, and representatives, whether a COVID-19 infection occurs before, during or after participation in a Albion College summer camp program.

      I certify that I have custody of Participant or an the legal guardian of Participant by court order. I HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND AND AGREE TO ITS TERMS. I AM AWARE THAT THIS AGREEMENT INCLUDES A RELEASE AND WAIVER OF LIABILITY, AN ASSUMPTION OF RISK, AND AN AGREEMENT TO INDEMNIFY RELEASEES.
